The US State Department, Office of Democracy , Human Rights e Labour (DRL) announces an open call for organisations interested in submitting applications for programmes that support the protection of human rights and fundamental freedoms in the Ukraine during the war and in a post-war context.

Objectives may include, but are not limited to: 1) Detained Ukrainian civilians and prisoners of war and their families receive the necessary support, including legal assistance; 2) Local and international entities working to support detained Ukrainian civilians, including political prisoners, and prisoners of war, including their families, are better equipped and better networked to provide them with the necessary support and defend their interests; and 3) The local and international public is better informed about these cases in order to advocate for the release of detained Ukrainian civilians, including children political prisoners and prisoners of war.

Possible activities may include, but are not limited to: providing legal assistance with the involvement of local and/or international lawyers; strengthening the capacity of local lawyers with regard to international law humanitarian (IHL) and international human rights law (IHRL); develop and empower/dynamise dedicated and/or cross-sectoral networks of support providers, lawyers, families of detained individuals, relevant entities among government, international organisations and the non-governmental sector, including human rights and human rights groups. civil society as well as the victims/survivors themselves; training and training for grassroots networks and/or associations of relatives and friends of detained individuals; support for national and international coalitions and advocacy efforts; documentation and analysis of cases; legal support for the representation of victims in legal proceedings at national and international level; psychosocial and other support for victims/survivors, families, as well as service providers; and international advocacy and awareness-raising efforts.

All programmes should aim to have an impact that leads to reforms and have the potential for sustainability beyond DRL's resources. DRL's preference is to avoid duplicating previous efforts by supporting new and creative approaches. This does not exclude from consideration projects that improve or expand existing successful projects in a new and complementary way.

Content of the proposals
  • When developing competitive proposals, candidates should consider the following elements:
    • Capitalise on ongoing efforts in this space to further develop and expand existing networks and build new ones if necessary, including all relevant stakeholders. Coordinate with existing official structures and bodies working to identify, locate and return prisoners of war and detained civilians, including children and political prisoners, as well as official structures at national level in Ukraine and at international level, including specifically those supported by international organisations such as the ICRC and the UN.
    • Identify, involve and support lawyers, both nationally and internationally, in order to support prisoners of war, detained civilians, including children, and their families, and provide them with the necessary assistance, including legal aid.
    • To shed light in a robust and comprehensive way, both at national and international level, on the cases of political prisoners held in (or in the context of) Crimea and the situation of the local population, especially ethnic Crimean Tatars, in order to expose abuses and hold perpetrators accountable.
    • Budget a bottom and develop clear selection criteria to focus on possible emergency needs of lawyers, especially those working in restrictive environments, and other service providers in need, family etc. -social support and other assistance needed by civilian detainees, including children, and/or prisoners of war released or repatriated to Ukraine.
    • Integrate a trauma-informed, do-no-harm approach into programme design and overall implementation. Such an approach will recognise the unique traumas affecting the target communities, fully integrate trauma knowledge into policies, procedures and practices, and actively seek to resist re-traumatisation. In a practical sense, the programme should also seek to develop the health mental health and psychosocial support for partners and their beneficiaries.
Ineligible activities
  • Activities that are not normally permitted include, but are not limited to:
    • The provision of humanitarian assistance;
    • English language teaching;
    • Development of high-tech software and/or hardware for computers or communications;
    • Purely academic exchanges or scholarships;
    • Exchanges or external scholarships lasting more than six months;
    • Offshore activities that are not clearly linked to initiatives and impact on the country or that are not necessary for security reasons;
    • Theoretical explorations of human rights or democracy issues, including projects aimed primarily at research and evaluation that do not incorporate training or capacity building for local civil society;
    • Microloans or similar small business development initiatives companies ;
    • Initiatives aimed at a diaspora community and not at current residents of the target countries.
Election criteria
  • The DRL accepts applications from non-profit organisations/non-governmental organisations (NGOs) based in the USA and abroad and international public organisations; educational institutions private, public or state-owned higher education institutions; and for-profit organisations or companies. DRL's preference is to work with non-profit organisations; however, there may be some occasions when a for-profit organisation is more suitable.
  • Applications submitted by for-profit organisations may be subject to additional review after the panel selection process. In addition, the State Department prohibits profit to for-profit or commercial organisations under its assistance awards. Profit is defined as any amount that exceeds allowable direct and indirect costs. The allowability of costs incurred by commercial organisations is determined in accordance with the provisions of the Federal Acquisition Regulation (FAR) at 48 CFR 30, Cost Accounting Standards Administration and 48 CFR 31 Contract Cost Principles and Procedures.
  • Cost sharing or matching
    • Providing cost sharing, matching or cost participation is not an eligibility factor or requirement for this NOFO and providing cost sharing will not result in a more favourable competitive ranking.
  • Other
    • Applicants should have existing active partnerships, or have the capacity to develop, with relevant thematic or national partners, entities and stakeholders, including private sector and NGO partners, and have proven experience in managing successful and preferably similar projects. DRL encourages applications from foreign-based NGOs based in the geographic regions/countries relevant to this NOFO. Applicants may form consortia in order to bring together organisations with varied expertise to propose a comprehensive programme in a single proposal. However, one organisation must be designated in the proposal as the lead applicant, with the other members designated as sub-grant partners. concession . DRL reserves the right to request additional background information on applicants who do not have prior experience administering federal grants, and such applicants may be subject to limited funding on a pilot basis.
